Relevant Legal Bases

Below you will find an overview of the legal bases of the GDPR on the basis of which we process personal data. Please note that, in addition to the provisions of the GDPR, national data protection regulations may apply in your or our country of residence or registered office. Should more specific legal bases be relevant in individual cases, we will inform you of these in the privacy policy.

  • Consent (Art. 6(1)(a) GDPR) – The data subject has given consent to the processing of his or her personal data for one or more specific purposes.
  • Performance of a contract and pre-contractual requests (Art. 6(1)(b) GDPR) – Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • Legal obligation (Art. 6(1)(c) GDPR) – Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • Legitimate interests (Art. 6(1)(f) GDPR) – Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data.

In addition to the data protection regulations of the General Data Protection Regulation, national data protection regulations apply in Germany. These include in particular the Act on the Protection against Misuse of Personal Data in Data Processing (Federal Data Protection Act – BDSG). The BDSG contains in particular special provisions on the right of access, the right to erasure, the right to object, the processing of special categories of personal data, processing for other purposes and transmission, as well as automated individual decision-making including profiling. It also regulates data processing for employment purposes (§ 26 BDSG), in particular with regard to the establishment, performance or termination of employment relationships and the consent of employees. Furthermore, the data protection laws of the individual German federal states may apply.

Security Measures

In accordance with the legal requirements and taking into account the state of the art, the costs of implementation and the nature, scope, context and purposes of processing, as well as the varying likelihood and severity of the risk to the rights and freedoms of natural persons, we take appropriate technical and organisational measures to ensure a level of protection appropriate to the risk.

These measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical and electronic access to the data, as well as access to, input, disclosure, ensuring availability and separation of the data. We have also established procedures to ensure that data subjects' rights are exercised, that data is erased and that we respond to threats to the data. Furthermore, we take the protection of personal data into account as early as the development or selection of hardware, software and procedures, in accordance with the principle of data protection by design and by default.

TLS encryption (https): To protect the data you transmit via our online services, we use TLS encryption. You can recognise such encrypted connections by the prefix https:// in the address bar of your browser.

Transfer of Personal Data

In the course of our processing of personal data, it may happen that the data is transferred to or disclosed to other bodies, companies, legally independent organisational units or persons. Recipients of this data may include, for example, service providers commissioned with IT tasks or providers of services and content that are embedded in a website. In such cases, we observe the legal requirements and in particular conclude appropriate contracts or agreements with the recipients of your data that serve to protect your data.

Data Processing in Third Countries

If we process data in a third country (i.e. outside the European Union (EU) or the European Economic Area (EEA)), or if the processing takes place in the context of the use of third-party services or the disclosure or transfer of data to other persons, bodies or companies, this is only done in accordance with the legal requirements.

Subject to express consent or a transfer required by contract or law, we only process data, or have it processed, in third countries with a recognised level of data protection, on the basis of contractual obligations through so-called standard contractual clauses of the EU Commission, where certifications exist or on the basis of binding corporate rules (Art. 44 to 49 GDPR, information page of the EU Commission: https://commission.europa.eu/law/law-topic/data-protection/international-dimension-data-protection_en).

Erasure of Data

The data processed by us will be erased in accordance with the legal requirements as soon as the consents permitting its processing are withdrawn or other permissions cease to apply (e.g. if the purpose of processing this data no longer applies or it is no longer required for the purpose). If the data is not erased because it is required for other and legally permissible purposes, its processing will be restricted to these purposes. This means that the data will be blocked and not processed for other purposes. This applies, for example, to data that must be retained for commercial or tax law reasons or whose storage is necessary for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person.

Our privacy notices may also contain further information on the retention and erasure of data, which takes precedence for the respective processing operations.

Use of Cookies

Cookies are small text files or other storage records that store information on end devices and read information from them. We only set cookies for web analytics with Google Analytics, and only if you have given your prior consent (see “Web Analytics with Google Analytics”). We do not use marketing or advertising services.

Independently of this, we use your browser's local storage for two technically necessary entries. These remain on your device and are transmitted neither to us nor to third parties:

  • Language selection: stores whether you use our online services in German or English once you choose a language yourself, so that later visits open the language version you chose. Nothing is stored unless you make a choice; your browser’s language setting is not evaluated for this purpose.
  • Cookie settings: stores your choice in the cookie banner (whether or not you have consented to Google Analytics), so that your decision is respected and the banner does not appear again on every visit.
  • Legal bases: The storage is strictly necessary in order to provide the functions you have expressly requested (§ 25(2) No. 2 TDDDG, German Telecommunications Digital Services Data Protection Act); consent is not required for this. Insofar as personal data is processed in this context: legitimate interests (Art. 6(1)(f) GDPR).
  • Storage period: The entries remain stored until you delete them via your browser settings.

Consent and withdrawal: Cookies and services requiring consent are only loaded after you have selected “Accept” in the cookie banner. If you decline, you will not suffer any disadvantage. You can withdraw your consent at any time with effect for the future – using the button below or the “Cookie Settings” link in the footer of every page. The legal basis for cookies requiring consent is § 25(1) TDDDG in conjunction with Art. 6(1)(a) GDPR.

Business Services

We process data of our contractual and business partners, e.g. customers and prospective customers (collectively referred to as “contractual partners”), in the context of contractual and comparable legal relationships and related measures, and in the context of communication with contractual partners (or pre-contractually), e.g. to answer enquiries.

We process this data in order to fulfil our contractual obligations. These include, in particular, the obligations to provide the agreed services, any update obligations and remedies in the event of warranty and other performance disruptions. In addition, we process the data to safeguard our rights and for the purpose of the administrative tasks associated with these obligations and business organisation. Furthermore, we process the data on the basis of our legitimate interests in proper and economical business management and in security measures to protect our contractual partners and our business operations from misuse and from threats to their data, secrets, information and rights (e.g. for the involvement of telecommunications, transport and other auxiliary services as well as subcontractors, banks, tax and legal advisors, payment service providers or tax authorities). Within the framework of applicable law, we only pass on the data of contractual partners to third parties insofar as this is necessary for the aforementioned purposes or to fulfil legal obligations. Contractual partners will be informed about further forms of processing, e.g. for marketing purposes, within the framework of this privacy policy.

We inform contractual partners which data is required for the aforementioned purposes before or during data collection, e.g. in online forms, by special marking (e.g. colours) or symbols (e.g. asterisks or similar), or in person.

We erase the data after the expiry of statutory warranty and comparable obligations, i.e. generally after 4 years, unless it must be retained for statutory archiving reasons. The statutory retention period is ten years for documents relevant under tax law as well as for commercial books, inventories, opening balance sheets, annual financial statements, the work instructions and other organisational documents required to understand these documents, and accounting vouchers, and six years for received commercial and business letters and copies of dispatched commercial and business letters. The period begins at the end of the calendar year in which the last entry was made in the book, the inventory, opening balance sheet, annual financial statement or management report was prepared, the commercial or business letter was received or sent, or the accounting voucher was created, or the record was made or the other documents were created.

Insofar as we use third-party providers or platforms to provide our services, the terms and conditions and privacy notices of the respective third-party providers or platforms apply in the relationship between the users and the providers.

The forms of processing also include performance assessment and the evaluation of our services and those of the teachers. In the course of our activities, we may also process special categories of data, in particular information on the health of the trainees as well as data revealing ethnic origin, political opinions, religious or philosophical beliefs. Web Analytics with Google Analytics

If you have given your consent, we use Google Analytics 4 to evaluate the use of our online services, e.g. which pages and articles are viewed, how visitors reach our site and which links (such as to book orders or to the podcast) are clicked. This helps us improve our content. Without your consent, Google Analytics is not loaded and no data is transmitted to Google.

For this purpose, Google Analytics sets cookies and processes pseudonymous usage data. We do not transmit plain data such as names or email addresses; for booking enquiries, only the selected service is recorded. Promotional Communication via Email, Post, Fax or Telephone

We process personal data for the purposes of promotional communication, which may take place via various channels, such as email, telephone, post or fax, in accordance with the legal requirements.

Recipients have the right to withdraw consent given at any time or to object to promotional communication at any time.

After withdrawal or objection, we store the data required to prove the previous authorisation to contact or send information for up to three years after the end of the year of the withdrawal or objection on the basis of our legitimate interests. The processing of this data is limited to the purpose of a possible defence against claims. On the basis of the legitimate interest in permanently observing the users' withdrawal or objection, we also store the data required to avoid renewed contact (e.g. depending on the communication channel, the email address, telephone number, name).

  • Types of data processed: Master data (e.g. names, addresses); contact data (e.g. email, telephone numbers).

Presences on Social Networks (Social Media)

We maintain online presences within social networks and process user data in this context in order to communicate with the users active there or to offer information about us.

We would like to point out that user data may be processed outside the European Union. This may result in risks for users, for example because it could make it more difficult to enforce users' rights.

Furthermore, user data within social networks is generally processed for market research and advertising purposes. For example, usage profiles can be created based on user behaviour and the resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside the networks that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the users' computers, in which the usage behaviour and interests of the users are stored. Furthermore, data can also be stored in the usage profiles independently of the devices used by the users (especially if the users are members of the respective platforms and are logged in to them).

For a detailed description of the respective forms of processing and the options to object (opt-out), we refer to the privacy policies and information provided by the operators of the respective networks.

In the case of requests for information and the assertion of data subject rights, we also point out that these can be asserted most effectively with the providers. Only the providers have access to the users' data and can take appropriate measures and provide information directly. Should you nevertheless require assistance, you can contact us.

  • Types of data processed: Contact data (e.g. email, telephone numbers); content data (e.g. entries in online forms); usage data (e.g. websites visited, interest in content, access times); meta and communication data (e.g. device information, IP addresses).
  • Data subjects: Users (e.g. website visitors, users of online services).
  • Purposes of processing: Contact requests and communication; feedback (e.g. collecting feedback via online form); marketing.
  • Legal bases: Legitimate interests (Art. 6(1)(f) GDPR).

Further information on processing operations, procedures and services:

  • Instagram: Social network; service provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland; legal bases: legitimate interests (Art. 6(1)(f) GDPR); website: https://www.instagram.com; privacy policy: https://instagram.com/about/legal/privacy.
  • Facebook pages: Profiles within the social network Facebook – We are jointly responsible with Meta Platforms Ireland Limited for the collection (but not the further processing) of data of visitors to our Facebook page (so-called “fan page”). This data includes information about the types of content users view or interact with, or the actions they take (see “Things you and others do and provide” in the Facebook Data Policy: https://www.facebook.com/policy), as well as information about the devices used by users (e.g. IP addresses, operating system, browser type, language settings, cookie data; see “Device Information” in the Facebook Data Policy: https://www.facebook.com/policy). As explained in the Facebook Data Policy under “How do we use this information?”, Facebook also collects and uses information to provide analytics services, so-called “Page Insights”, to page operators so that they can gain insights into how people interact with their pages and with the content associated with them. We have concluded a special agreement with Facebook (“Information about Page Insights”, https://www.facebook.com/legal/terms/page_controller_addendum), which regulates in particular which security measures Facebook must observe and in which Facebook has agreed to fulfil the rights of data subjects (i.e. users can, for example, send requests for information or erasure directly to Facebook). The rights of users (in particular to information, erasure, objection and complaint to the competent supervisory authority) are not restricted by the agreements with Facebook. Further information can be found in the “Information about Page Insights” (https://www.facebook.com/legal/terms/information_about_page_insights_data); service provider: Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland; legal bases: legitimate interests (Art. 6(1)(f) GDPR); website: https://www.facebook.com; privacy policy: https://www.facebook.com/about/privacy; standard contractual clauses (ensuring the level of data protection for processing in third countries): https://www.facebook.com/legal/EU_data_transfer_addendum; further information: joint controllership agreement: https://www.facebook.com/legal/terms/information_about_page_insights_data. The joint responsibility is limited to the collection by and transfer of data to Meta Platforms Ireland Limited, a company based in the EU. The further processing of the data is the sole responsibility of Meta Platforms Ireland Limited, which concerns in particular the transfer of the data to the parent company Meta Platforms, Inc. in the USA (on the basis of the standard contractual clauses concluded between Meta Platforms Ireland Limited and Meta Platforms, Inc.).

Changes and Updates to the Privacy Policy

We ask you to regularly inform yourself about the content of our privacy policy. We adapt the privacy policy as soon as changes in the data processing carried out by us make this necessary. We will inform you as soon as the changes require an act of cooperation on your part (e.g. consent) or other individual notification.

Where we provide addresses and contact information of companies and organisations in this privacy policy, please note that the addresses may change over time, and please check the information before contacting them.

Rights of Data Subjects

  • Right to object: You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is based on Art. 6(1)(e) or (f) GDPR; this also applies to profiling based on these provisions. If the personal data concerning you is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent that it is related to such direct marketing.
  • Right to withdraw consent: You have the right to withdraw consent given at any time.
  • Right of access: You have the right to request confirmation as to whether data concerning you is being processed and to request access to this data as well as further information and a copy of the data in accordance with the legal requirements.
  • Right to rectification: In accordance with the legal requirements, you have the right to request the completion of data concerning you or the rectification of incorrect data concerning you.
  • Right to erasure and restriction of processing: In accordance with the legal requirements, you have the right to request that data concerning you be erased without undue delay or, alternatively, to request a restriction of the processing of the data in accordance with the legal requirements.
  • Right to data portability: You have the right to receive data concerning you that you have provided to us in a structured, commonly used and machine-readable format in accordance with the legal requirements, or to request its transmission to another controller.
  • Complaint to a supervisory authority: Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the GDPR.

Definitions

This section provides you with an overview of the terms used in this privacy policy. Many of the terms are taken from the law and are defined above all in Art. 4 GDPR. The legal definitions are binding. The following explanations, on the other hand, are primarily intended to aid understanding. The terms are sorted alphabetically.

  • Controller: The “controller” is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
  • Personal data: “Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
  • Processing: “Processing” is any operation or set of operations performed on personal data, whether or not by automated means. The term is broad and covers practically every handling of data, be it collection, evaluation, storage, transmission or erasure.
  • Profiles with user-related information: The processing of “profiles with user-related information”, or “profiles” for short, includes any kind of automated processing of personal data that consists of using this personal data to analyse, evaluate or predict certain personal aspects relating to a natural person (depending on the type of profiling, this may include different information concerning demographics, behaviour and interests, such as interaction with websites and their content, etc.) (e.g. interests in certain content or products, click behaviour on a website or location). Cookies and web beacons are often used for profiling purposes.
  • Reach measurement: Reach measurement (also referred to as web analytics) is used to evaluate the flow of visitors to an online service and may include the behaviour or interests of visitors in certain information, such as the content of websites. With the help of reach analysis, website owners can, for example, recognise at what time visitors visit their website and what content they are interested in. This allows them, for example, to better adapt the content of the website to the needs of their visitors. For the purposes of reach analysis, pseudonymous cookies and web beacons are often used to recognise returning visitors and thus obtain more precise analyses of the use of an online service.
  • Tracking: “Tracking” refers to the ability to trace the behaviour of users across several online services. As a rule, behavioural and interest information relating to the online services used is stored in cookies or on servers of the providers of the tracking technologies (so-called profiling). This information can then be used, for example, to show users advertisements that are likely to match their interests.
